Per Curiam. Noah Dick Tomlin and his wife, Juanita, pled guilty to attempting to purchase 21 pounds of marijuana, in violation of 21 U.S.C. Â§ 846. Judge Wilhoit sentenced Mr. Tomlin to 16 months imprisonment. Mr. Tomlin appeals, claiming that he was sentenced harshly, in contravention of the First Amendment, because he publicly embraces the view that marijuana should be legalized. For the reasons given below, we affirm the district courts sentence.
